Dear seniors,
Please answer my query, that I have resigned my previous company, and I want to claim my bonus amount, but they are saying that I have to go their and sign in the form C and form D to get the check of Bonus.
Is it necessary to sign to go their and sign on these forms for a resigned employee and is it not accepted that I give receiving on a separate letter of accepting the bonus amount and suggest any other way to get the bonus check, because it is not possible for me to go and sign on the form C and form D.

Dear HR Monster,
For bonus the employer has to seek forms that has to be filled in -
- A register showing the details of the amount of bonus due for each of the employees and their deductions under sections 17 and 18 and the amount actually disbursed, is Form C.
- Annual Return – Bonus paid to employees for the accounting year ending is Form D.
These forms are to be signed by the employer. Please check with your company again.

The employees signature is meant to be receiving. You must any way go to get your Bonus amount and therefore you have to verify and sign. Talk to your employer the best doable way to sort this thing out.

As per the Companies Rules. It is necessary to sign the documents. Which are related to your re-leaving. If you will not sign then by going over there. That means you are loosing your bonus. I faced this situation in my life. Because Company is also binned by some set of rules and regulations. So they have to perform in same way. So its good for you to go over there and sign the documents after reading all the document. It will not let you face any kind of problem in getting your bonus plus conversion of your bonus check in cash as well.
I have shared my experience. I hope it will help you to get out of this situation.

The employer is not denying to pay the Bonus.
Signature on form C is mandatory in nature. As such the employer cannot be forced legally.
However, it can be mentioned in the Colum of signature that “paid by a/c payee cheque and separate receipt obtained” that will serve the purpose, and practically it is done subject to employers satisfaction.
Sharmila ji has rightly advised you to request your employer and find a way out.

There is case of one of our employee, you may say type of casual worker who has been engaged by us for our misc.work at one of our site, we are giving him a fix salary. due to some repeating misconduct we wish to kick him off from our end, mean time there is his doughter\'s marriage so he is going to leave but at the moment as we saying him to leave the job he is asking for 1month notice pay along with his leave,bonus.
So, kindly guide me, with ur valuable response. will i have to pay him as per contract lab act?, He is with us since April\'12 and we appointed him orally. There is no written correspondence between us.
