Hi,
My dad is having a small scale business with not more than 6-7 people employed at any point in time.
One of his employee who had been working here for around 15-20 years is now having some problem staying in the organization and would like leave the job.
1. His salary has been slowly increased from 500 to 8000 over the period of time (total salary including basic).
2. He also has a due of around 35,000 Rs.
Now, he wants a service certificate and is asking for some settlements (financially). Looks like he wants to apply for a case if required. Please advise what is the correct procedure.

1) Gratuity Act - Not Applicable
2) Bonus Act - Not Applicable
3) Factories Act (Annual Leave with wages) - Not Applicable
4) Leave Travel Assistance (Based on Terms & Conditions of Employment)
5) PF & ESI Act - Not Applicable
You need to provide the following documents
A) Service Certificate
B) No Dues Certificate from all department & Relieving letter
Your Father is Liable to pay
1)Salary during the month
2)Unpaid salary(if any)
Less deductions (Viz Loans & Advances, Others etc)
If Earning are more than deductions, You may release the above certificates
If Deductions are more than Earnings, You may hold the above certificates.
