Hi All, A contractor is not covered under EPF act but principal employer is covered, will employees provided by the contractor are entitled for EPF or not? Please help in explaining.
From India, Delhi
If the establishment where the contract labour are engaged is covered by EPF (as also ESI) the contract labour are covered by EPF/ ESI, even if the contractor is not covered. In such scenario the contractor's employees will have to be given coverage under the Principla employer's registration.

IF WORK IS DONE IN THE PREMISES OF THE PRINCIPAL EMPLOYER THAN ALL THE CONTRACT EMPLOYEES WILL BE COVERABLE UNDER PF PROVIDED THEIR BASIC+da ARE BELOW Rs6500/-

Dear Sandeep,
I fully agree with the opinions given to this thread. I will like to add that it would be better to direct the contractor to obtain separate EPF code number and get coverage rather than inducting them in your pf code.
