Could you anyone please advice on the below.
I went onsite to serve my cilent for 1 year and came back in this August. As per agreement I have to serve my company for minimum period of 6 months. It is almost 3 months I came back to India and 3 months is the notice period as per company policy. Now I am planning to leave this company due to personal things to be settled in my hometown.
I am ready to serve 3 months period. My quey is will this notice period added to minimum service period as per agreement? or Do I need to serve 6 months minimum and then I have to serve 3 months notice period(total 9 months)?
Can it be fine if my notice period overlaps with minimum service period 6 months?
Below are the points concerned about in the agreement. Point 6 says tyo serve minimum 6 months and point 8 says \"(c) fails to serve the Employer for the period specified. In addition to this, the Employee is also governed by the three month’s notice period as per Company policy.\".

The Point 8(c) of the Agreement you mentioned is clear on the query you raised--the key words being "In addition to this". Why did you get the doubt when it's so clearly mentioned?

It means, you can not resign the company before 6 months and notice period will be effective only after completion of 6 months, so in toto 9 months is the minimum work period including notice....... Mr. Tajsateesh has easily cleared the point for you.........

My mgr had requested to serve 3 more months onsite and when I come back to India,I have to serve 6 months.If I plan to resign he will adjust that 3 months so that I need to serve 3 months only.
Moreover point 6 says, \"Minimum service period is 6 months\", If I serve 3 months notice it will become 6 months.
I have checked with many of my friends, everyone says, that means to say even if you serve 6 months , you cannot simply leave the org, you have to serve 3 months notice whether it is before 6 months or after 6 months..

This is not really an issue at all indeed to be frank. very simple matter. As per the agreement your explanation does not suit in this case. But as I already said its a trifling case...... You serve a notice now, if your Manager accepts it then nothing to think about, if your Manager does not accept your notice send him a 6 months Notice period, minimum of 3 months is Mandatory, who says you should not serve notice for 6 months!! Request for your Manager for relieving you as soon as possible.............
Try to complete your work assigned to you as early as possible, so that you can request you Manager, afterall you can not leave the company abruptly, one of the purposes of notice itself is to avoid the abrupt disposal of works..........
Before listening to your friends read their agreement, if those mention the terms " in addition to"........
And for your information, Clause 6 has to be read with other clauses of the agreement under law, it does not hold good alone........
