Hi,
I have come across cases, wherein , the employees who go for Maternity leave and get the benefits of the Maternity Act does not return back to work after claiming the benefits & resign without reporting back to work. What does the law say abt such cases? How can an employer deal with such employees who end up providing benefits to the employees and not having them reporting to work back?

look its a benefit , given by employer, which is a social obligation on his part..so donot see the matter with such sentiments...dont think its the benefit which will make them return back...its their right...not obligation, but from employers side its obligation, that's the catch.
now you should have appropriate clause stated in your service rule book/or in the appointment letter itself, about resigning from employment, ie, employee have to serve notice period for 1/2/3 months or pay equal amount of salary..or any other legal clauses..but from maternity benefit viewpoint, there is no such clauses in the act, which states that you can stop any beneficiary from leaving your contract of employment.

Dear Mr Mukherjee said rightly.she is entitle to get benefit but same movement she has to serve noticev as per the term and conditions of appointment
