Have query wrt to
EL eligibility & encashment
1. Can EL be encashed the same year it was given; say for eg: Jan2012 a person has 14 days based on 2011; no carry fwd. So can a portion of the leave be encashed within Dec 2012 itself or can it be encashed only in 2013. Is there any statutory policy or it's company policy wrt to encashment.
2. If a person has not worked for 240 days in prev year but has worked more than 2/3 of the year ie min 8 Months in previous year he is also eligible for EL from Jan on the following year; is this correct? (no. of days worked in 8 months/ 20).
So a person should work 240+ days or more than 8 months to be eligible for EL the following year
CL eligibility
1. CL 10 days how is it eligible for a person joining middle of year for the same year - will prorata days based on balance months be given or will he not be eligible for CL the year he joins.
For following year Jan how will CL be issued if he has not completed 1 yr .

HI Regarding CL you shall consider on Prorata basis. Regarding encashment of EL Statutory part it just tells as it shall be encashed. For that you shall prepare policy for encashment of EL

Ex: If an employee joined in March 14th-12.
Note: His working months are 8months.
Cal: 10/12*8= 6.5 days.
He will be get 6.5 days CL.
Seniors: Do let me know is this calculation is correct or not?

Please note the following-
According to the Shops & Establishment Act,1963 a person employed in a shop or an establishment shall be entitled:
PL/EL(Privilege leave/Earn Leave)-For every completed year of continuous services, to privilege or earn leave on full pay for fourteen days.PL/EL admissible under clause (a) may be accumulated up to a maximum of not more than 28 days.
Though it varies company to company.
CL (Casual Leave)-In every year, to casual leave on full pay for ten days.CL admissible under clause (c) shall not be accumulated.During the 1st year of service, employee will not be eligible to any leave except CL considering the proportion of service rendered in the relevant Calendar year.
Leave Year: 1st April to 31st March.
Admissibility: Casual Leave will be due from the date of joining service and calculated on pro-rata basis.Earned Leave on completion of one year from the date of joining service. A person who ceases to be an employee, before completion of one year, will not be entitled to Earned Leave.
Frequency of taking leave:
a) Casual – Subject to maximum of 3 days at a time except in cases of sickness and previous permission in writing of the employer. Half day Casual Leave will also be admissible except on half working day.
b) Earned – Upto 3 times in a year with a ceiling of 14 days at a time, except in cases of final service severance. The Ceiling of 14 days may be relaxed in case of prolonged illness or for any other reason specially sanctioned by the Management.
Encashment of Earned Leave:
Earned Leave will be encashed exceeding of 30 days(Varies Company to Company) leave balance in a leave year.
This facility will be allowed to those whose leave will surpass the accumulation limit. If the surpassed figure is less than 20 days, the staff members will get encashment for those days only which would have been lapsed.
