Respected Sir / Madam,
I am 5 months pregnant and currently working for a company which is 2 hours away from my place and in total it takes nearly 4.5 hours of travelling. I want to cut down on my travelling and hence found a job which is close to my place however i am worried if I would be recruited if the employer learns about my pregnancy. Is there any policy which restricts me from joining? or any policy which is in my favor? Secondly, if i join this company in september 2012, i am due for delivery in December 2012 so would I get maternity benefits?

As per Maternity Benefit Act,1961 "No woman shall be entitled to maternity benefit unless she has actually worked in an establishment of the employer from whom she claims maternity benefit, for a period of not less than 12 weeks [eighty days] in the twelve months immediately preceding the date of her expected delivery".

So if I join the company in the month of September 2012 and go on a leave in December 2012 which means I have worked for more than 90 days then I am entitiled to get Maternity Benefits, right?

My Suggestion. Don't leave current Job. You are playing around dates, which is not in your hand but God alone.
You may apply for "Early rest" with request "due excessive traveling, which is not medically advisable under your condition." You may go on "Leave without Pay" and also later claim Leave and pay as per Maternity Benefit Act.

Anju and Mitra has rightly suggested. Leaving the current job is not the right decision. And you can not legally claim the maternal benefits...... and also the companies avoid recruiting such candidates, which do n to wish to take risk and invest on such candidates who could not benefit them in the near future......... Many times even if you are selected in the interviews the companies do not take you in immediately where you lose the days for the count, chances are more that the company can withhold the benefits by appointing you lately if they really feel that you are the candidate should not be missed recruiting in to the company....... in simple words there are very less supporting opportunities and circumstances that you could look for by switching the job........
