Ours is a service industry and we operate in whole of India with branches and our permanent employee strength is 40. Apart from this we have two persons on contract one person is is a full time employee and another is a part time employee . We request for employment contract for both the above contract employees . Request for information - can any one send me the case laws details on waiver of interest charged for EPF delayed payment from the actual date of eligibility till the actual date of payment to EPF department. We started our company in 2001 as a private limited Co and completed formalities and the promoters ,i.e. two whole time Directors were doing trading activities till 2005 . In 2005 we started some more activities and included more people and by 2009 we were more than 20 employees and then were eligible for EPF and ESIC . In 2012 we voluntarily applied for registration and paid the old contributions as well started the monthly contributions regularly . All of a sudden EPF department have demanded interest for the delayed payment of arrears . We would like to know can this interest be waived and if so we would like to know some past similar cases for making our submissions to the department.
