One of my employee(unmarried and parents have already died) covered under ESIC met an accident and died. He is having one Sister (21years unmarried and Depending totally on my employees income), One Brother( 24Years married leaving seperatly and not depending on my employees Income) , and Maternal Grand mother ( 85 years old and completely dependant on my employees salary). The ESIC claim was approved for Maternal Grandmother by Ho but the process was stopped in between saying that maternal granmother cannot get the benifit. Is this true? then who is eligible for the claim?

Hi reply for the question is, it is eligible for her sister,there is possibility to claim by her sister,if she is studying, in case if she is an employee even she is also not eligible. Sravanthi

1. Sir, you have not mentioned whether the said employee was having insurance number and identity card under ESI Act.
2. Kindly also intimate the reasons of death of the employee ? Whether the said employee died as a result of any employment injury out of and in the course of employment ?

Dear friend, You simply buy a Maharastra State Rules of Employees State Insurance Act 1948 and you will get all answers in relation to 'who are dependable to an Insured Person'. Look ESI Corporation is social security organisation and they are not vindicative to any member to refrain him from getting reasonable bebefit. They are guided by the Rules and not by the emotions. Thanks.

Sir, ESI Act, 1948 is administered by Central Govt. and therefore, there are no "Maharashtra State Rules of Employees State Insurance Act, 1948" which may be applicable in the situation as raised by one of members as above.
