hi ,
I am working as HR in a company. I need complete process on leave. As I know company is providing various kind of leaves eg cl,pl.sl,maternity leave etc. Here my question is an employee who joined in the company get's the total no of leaves as per policy of the company or providing leaves on pro rata basis? In probation period whether person is getting full benefits of leaves? how many leaves will he benefited after completion of 6 month when he gets confirmation.

Hi Sanjay Bhatia,
CL and SL are given to employees on pro rata basis only and based on company policy even if an emplyee is on probation period also the leaves given to him on pro rata basis, after confirmation of an employee the statute compliance will apply and according to it he entitle of leaves.

An employee does not get entitlement to leave unless he completes 240 days of service in a calender year either under the Factories Act or Shops Act of most of the States(please verify your Stae Act) However the company can make a special provision under it's policy to provide for leave on pro rata for probationers. However the CL and SL can be allowed on prorata, if the company wishes to do so by making a suitable provision under the Standing orders or it's leave policy whichever is applicable to it.

Hi,
If an employee joined on 1st April 2012 and completing his probation period after six months i.e. on 30/09/2012. As per company rules he will be entitled for all kinds of leave after confirmation. so can someone please help me with the calculation of leave period i.e is to be considered. Is it from joining date or from confirmation date?

Mr.sanjay Both are same in their charcter in that in both cases the leave is earned by an employee on the basis of the number of days worked by him in a calaneder year. B.Saikumar Mumbai
