Dear Friends, I run my own hiring company. We were approached by a company manager to hire few frontline salespersons for them. We sent the T&C on mail and got his acceptance after which we started sending candidates. 4 got selected and hired. Now when we sent the hard copy of the same T&C along with the invoice the MD refuses to pay the % that was accepted earlier by heer manager. She said she will pay half of it. What can I do in this case? Can someone pls help?

Ms. Simi, As u have got their acceptance which means u & concern firm have been entered into a agreement. Thus, u have right to approach law regarding the same FYI pl.

Thanks Hitesh, Can you give me any clues on how to go about doing this? I am in Gurgaon and so is the client. I am not that savvy about legalities. Would truly appreciate a response. Regards

Ms. Simi,
U can walk in directly to local court by submitting an application following with a filled complaint form named Complaint Form - Breach of Contract which u can download from internet. After fulfilling respective duties u can file a case with the help a of a public lawyer. Remember one thing, do hire a public lawyer instead of private one.

Well im not agree with Mr Hitesh Arora

And Simi, how can you business on a base of an EMAIL ACCEPTAINCE or without having any proper Agreement/ Acceptance of Proposal in physical with them. This is not the right procedure and work style to run any Business

You need to adopt a proper system if you still are not having the same.

Now, I wanna let you know that you can’t treat their EMAIL acceptance as an AGREEMENT with you though this can be count as only CONSENT not an agreement which has a unique power and dignity and a different meaning in legal prospective.

I understand your concern but if you never had any paper work with them, you can’t take legal action against them.

Second, I would suggest you to visit them and try to negotiate and convince them with humble gesture and this can only work for you.

@Mr. Harish, can you please let me know about any case where one has taken the legal action again anyone on a base of an EMAIL Acceptance? I’d be really grateful to you. Because there are number of people are accepting email offers and refusing and if people started taking action on just basis of Email acceptance, then we all can imagine how much is gonna increase on LEGAL SYSTEM and TIME gonna waste ...

Thanks for your revert. Yes I did the mistake of trusting a company's MD and honoring the mail her manager sent as acceptance of our T&C. We had never encountered any such instances earlier as we have been dealing with over 25 MNCs. But you are right and I have learnt my lesson. The thing is the targets and incentives of my employees are linked to the closures. anyways, will take you advise and meet her and see how it goes.

There is a big difference between spams offers from unauthorized senders or a proper acceptance mail from a registered sender. Hope u understand the difference between both of them.

As i m talking about east & u r understanding the same as west. Spread ur thinking Mr. Arora pl.

& As far as about spam offers or mails for which u r talking about...get some useful info from me dear.. ...

RBI has warned the general public against fraud emails bearing its name being sent by people asking customers to share information.

It was come to its notice about an email from mail id: , which was signed by RBI Online offering a new online security platform.

RBI said that according to the mail, the new online security platform offers to prevent online identity theft in Internet banking by asking the customer to go through a two-way authentication factor before he/she properly logs into Internet banking every time and added that the email further asks the recipient to download attachment and update.

"The Reserve Bank clarifies that it has not sent any such mail. In fact, it does not have any mail ids with extension @rbi.Org," the notice said. RBI cautioned the public not to open such mail or try to download the attachment on their computer.

It could be a phishing mail and downloading the attachment could result in identity theft.

Hope the above info would help u in improving ur mind muscles & ur attitude towards things which must be fight for your right instead of backing off.. ...

You not just have defined me here but to yourself and for this, I sincerely offer my special thanks to you. I won’t criticize you or say anything wrong as you’ve done above but request you to PLEASE COME TO THE MAIN TOPIC.

I do understand the difference between unauthorised sender and proper acceptance but the same you need to understand bcz there is nothing like you were talking about SPAM/PHISHING MAIL or anything like unauthorised sending or acceptance or so on. I was talking about a work style, procedure and system of doing Business that I have conveyed to Ms Simi and she also has got that but you took it a wrong way. i dont know what made you feel like you have reacted like this....

I also asked you a question above but instead of answering you started talking about what SPAM /PHISHING, RBI disclosure which was not required.

A criticism is also an important thing for life and has style and system but it seems you don’t know about it. I never said that you are wrong or right but that I am not agree with you.

I can also reply you on your language that you have used in last line of your reply in a correct manner but I believe you'd require more maturity to understand, therefore, there is no need to say more ..
