Dear All,
We have recently launched our new retail store in New Delhi, now we require it to keep it open 7 days a week, pls let me know the procedure for applying for the same, which form needs to be filed, to which authority? is it possible to apply onl? and what is the fees for it?

Shops and Commercial Establishments Act is a State Act and hence the Act differs from state to state. But the main objective will be the same. Therefore, one thing is sure that no establishment can work on all the seven days in a week without closing it for a day which is mandatory under most of the Acts. However, the Govt. have given exemption from the operation of this particular section whereby a particular firm or a particular kind of firms can get exemption. For example, hotels and restaurants are given exemption from the operation of the provision which enables hotels to function on seven days. Similarly, the restrictions relating to early opening of the hotel before 6 am and closing of hotel at 8 pm may be exempted. IT companies are also given similar exemptions which enable them to have flexible timing. Therefore, it depends upon the type of shop and its relevance in working for 7 days.

First of all thanks for your reply, hare in particular i was talking about Delhi Ship and establishment act as our store is located in New Delhi and i know the provisions under the act what i was asking is the procedure to apply for the exemption, our store is a luxury home decor retail store

You have to meet the Labour officer and apply for exemption. Since your shop is not one which is dealing with essential commodities, I feel you have to do a lot of pressure to get exemption. Being an IR professional who believe in professional ethics I am not supposed to recommend a way by which your kind of shop which is not in the trade of any essential commodities can get any exemption.

Dear Sugandha,
You plz. approach labour authorities for 365 days license. Now a days many number of shops have been taken 365 days license and keep opening the shop all along the year.
There is a some amount of money (exactly not known may be Rs.50000/-) needs to paid and some self written "No objection" needs to be taken from the employees who are working in that shop.
The labour department will give the 365 days license

Dear Sugandha,
My knowlege and practical experience are limited to that of "Tamilnadu Shops and Estt Act,1947"only. The power of exemptions granted u/s 6 of the T.N Act empowers the Govt to exempt either permanently or for any specified period any establishment or class of estts from all or any of the provisions of the Act subject to certain conditions as it deems fit.A number of prominent establishments have got exemption from weekly closing day i.e Section 11(1) of the Act.Iam not sure such a provision is available in the Delhi ACT. If available you can apply for exemption as suggested by Madhu.

Can anybody guide me that is there any notification from Tamilnadu Govt. for 365 days shops will remain open.
I have seen notification of Maharashtra, Andhra and Telangana Government.
Please guide and provide a circular also.
