Is there any who can tell me about eligibility for EPF, CL & AL. Actually I am working Part Time with on Esteemed NGO since last six years. they are not giving me CL & AL as I am on part time basis. Is it right even if they cut leaves from salary. similarly they are not deducting EPF. I donīt know what is the law? is there any one who can tell me the proper law?

Dear Mr. Deepak
First of all let us know whether you are engaged for Part time job on Contract basis or on Payroll. As per my knowledge you are not entitled for AL since you are not full time employee and so you cannot be a permanent employee too as per the eligibility criteria. With regards to CL am not sure but you should be entitled for CL.

thanks alot for ur reply. yes I am working on payroll basis not on contract basis. I got monthly salary & Increments regularly. yes I know AL is not applicable for me but what about CL even when they deduct my salary for my absents. In my opinion if they have right to deduct the absents from salary then I have also right to get the CL? is It right or wrong? Pls saji ji tell me if you know abt that.

If you are on payroll then please refer the Appointment Letter/Agreement you are entitled for CL/SL too. If your agreement mentions that you are on for a contract term of say 3 years or 5 years for a particular project then I am helpless I dont have any clue as the same is termed as contract and not as employee. Please go through the agreement and let me know the exact terminology used in the letter.

sorry to disturb u again & again. Actually there is no agreement or contract like document for my appointment. I am appointed here in NGO by referral of one of the trusty of this NGO because I am also Working for him that is why he referred me to this NGO 6 year before. Here my working hours are 10 am to 1 am since last six year & I am getting my salary on monthly basis as others gets normally. they Deduct my leaves from salary that is why i feel that if they deduct leaves then I should be entitle to get CL also as others also getting. I am very confused. pls let me know.
