Few of our operators are misutilizing ESI benefits in following ways :
1) Frequently they avail for sickness benefit for excessevly long leave period.
2) Even for the treatment of minor injury they take long leave.
3) Maternity leave too is extended beyond prescribed period.
On personal investigation by us it is found that they are 100% medically fit and enjoying their personal life.
All above are being taken on false ground to ESI dispensary. Even ESI personnel are encouraging such practices for their personal interest.
Could i be guided for tackling such issues. Can authencity of medical rest advises issued by the ESI dispensaries on false ground be channenged.

Pl. collect all the sickness certificates of all the employees, prepare a statement, submit to the local office manager and ask for the fitness of those employees / ask for a certificate of unfit.

With this he will immediately write to the Hospital superintendent / medical officer of the concerned dispensary, the same will arrested. Only the thing is there will be lot of pressure from those operators on you because the local office manager / the hospital superintendent / the medical officer of the concerned dispensary don't take the responsibility because they are scared of these workmen and related unions hence they will clearly communicate that they don't have any issue of extending the benefits but after getting the complaint from the management they can't do hence all the workers / unions will create the nuisance with you.

I faced this music and successfully arrested, I have submitted a copy even to the regional director also. The concerned Medical officer of the dispensary got transferred also. The workers and unions created lot of issues but there after no false ESI leaves .
