Hello Dear, Would you please tell me that,What is the differences between Termination & Dismissal?

Thanks for your reply.
As far I know that if an employee is terminated then s/he shall get the benefit such PF, Earned Leave, 1 month Salary(as prescribed in Appointment Letter) etc but if s/he is dismissed then the respective person shall not be eligible for any benefit.

Termination means "অবসান", which may be from the employer or employee (resignation). But Dismissal means "বরখাস্ত", which only from the employer part. According to the Bangladesh Labor Law, if any employee dismissed for the reason of "theft, fraud or dishonesty in connection with the employer's business or property" then he/she will not entitled for any compensation. But other any case he/she will get compensation. Please see Section 23, 26 & 27 of Bangladesh Labor Law.

Dear Mr. Rabbany,
There are distinction between dismissal & termination according to Bangladesh Labour Law 2006. Hope below articulation will satisfy your query.
Dismissal is done on the ground of disciplinary action. To dismiss an employee from service there are certain steps that need to be followed as per Bangladesh Labour Law 2006. For dismissal an employee is entitled for due salary, PF & Gratuity (if applicable).
Though termination means discontinuation by either party but according to Bangladesh Labour Law 2006 termination is to discontinue an employee by employer without assigning any reason. According to Bangladesh Labour Law 2006 to terminate an employee employer must give him 4 (four) months notice or 4 (four) months’ salary in lieu of notice period. Due salary, PF & Gratuity (if applicable) is also payable in this case.

Without any reason company can Terminate any employee.Company will send a termination letter but don't mention cause.For Termination company should pay 4 months salary and other benefits (PF,Gratuity or Compensation benefit).

For dismissal you have to send show cause letter ,form a inquiry committee,after proof you have to send dismissal letter.Employee entitle salary up to last working day +Compensation benefit and PF .
