hi...i am a sole proprietor of a firm doing manpower service& also a partner along with one more in another firm...i have got ESI & PF registration in my name & remitting the ESI of proprietor firm under this no....on the other hand the firm in which i am a partner is also having ESI registration in COMPANY FIRM name & ESI remittance are being done. now, the other partner of this firm wants to quit out. & if this happens i alone will be left.will this company also become a proprietor concern & If so can i remit the ESI & PF remittance of that firm under my individual firm ESI & PF No? can anyone please rectify in this regard. thanks

With referene to your query, you being sole proprietor in one concern and partner in another firm, on termination of the partnership deed on the exit of your partner, you will be treated as sole proprietor of the partnership firm, as per provisions of the ESI Act, 1948 and EPF Act, 1952, you are required to deposit monthly contribution for all of your concerns/firms separately, Consolidation in this regarding will not be allowed having different ESI and PF Code.
