First of all good morning to everyone and wish you all happy festivals coming in next 30 days or so.
I am in a fuss, please guide me. I need to appoint a supervisor for construction of our new building where our existing factory will be shifted. I want only one supervisor and my payment limit is only 10000/month. No one is ready to work in this rate as after deduction of P.F. & E.S.I. this amount gets even lesser and this is a 12 hours 31 days job a month for the whole project, means no holiday practically. Is there any other way to appoint a person for this work as per existing law without any deductions as mentioned above. Can I appoint him as a Contractor for this job so that he can work there on his own and submit his monthly bill of Rs. 10000, or as the case may be. If so, is it compulsory for him to obtain a License for work on contract even if he has practically not engaged any labour and is supervising himself. If this method is adopted will this be a legal or right practice. Please give your opinions and valuable advice. Regards,

Coming to your query it is not practically possible or viable to make through a contractor, in that case there is no relation between employee and employer, they don’t have any responsibilities, and they can left any time without any notice also.

And at the same time even contractor also 2% TDS has to deduct from the bill amount.

As per my knowledge there is no need to get the licensee, if work order below 10 (in AP 5) employees.

Dear Pon, Thanks for your advice, even I thought of it but in that case T.D.S. calculated is @10 % of the billing amount. This way Rs. 1000 deduction has to be done and this would benefit neither the company nor the appointee. Is there any other option ?
