Dear Sirs,
We are contractors employing 15 peoples and are giving PF to them for over 2 years.
Now we expect our strength to go beyond 20 and want to register with ESI also.
Can we register with existing 15 people or have to apply once the strength goes above 20?
If we get registered now, do we need to pay ESI contribution for the previous 2 years also(the period we started giving PF) or paying from the subsequent month?
Kindly clarify

ya u have to pay esic for 21members,no need to pay esic contribution for past two years,but you have to pay advance payment for employes for three months

If we have 21 members and 15 of them are working in esi non implemented area, are we elegible to get the code from ESI.
If we get it, do we have to pay esi for entire 21 employees or only those 6 ppl working in esi implemented areas

but 15 of them are working in uncovered area, and officials are asking for work orders to determine weather the work is being carried out in implemented area to cover all 21 employees, pls clarify

hello, according to PF Act, if your employees are more or equal to 20 then you have to be covered under the Act, deduct their monthly contribution and deposit the same along with the official contribution. The same holds good for ESI also. There is no harm if you cover your employees if the are below 20. On the contrary it a very nice behaviour as an employer. But what stopped you from covering your employees under ESI? Are your contract employees working in a project manufacturing site? Please consult the local office Manager of the ESI and get the necessary things done. If you would have covered your employees under ESI then all their health related problems would have been taken care by the ESI dispensary or hospital. Anyways, it is never too late. Please act fast.

Hello, as about the number of employees,i would always suggest that you cover your contract employees once the number crosses 10. In that case all the health related problems would be taken care by ESI irrespective of the number and you as an employer are saved from any of the problems arising out of health. The contribution is very meagre and small but it speaks volumes about you as a a good employer and consequently the health of the contract employees is taken care.

hello, there is nothing like ESI implemented or non implemented area. It is basically the availability of the ESI dispensary or health centre in the vicinity of the working area. Please discuss the same with the local office Manager and convey it to him that irrespective of the number of the employees you want all your contract employees to be covered under the act.
In areas where there is no ESI then WCA comes in to force automatically. But WCA is not at all effective as ESI. To find a solution to your problem you can also discuss with the officials of Panchadeep Bhawan, the ESI HQ. Contract employees are the most neglected. The act itself speaks of abolition and regulation of contract labour. So i would advise you to discuss the same with senior ESI officials in your working area and finsd a solution.


the problem is I have only 3 ppl working in implemented area.our consultant asks for 10 people working in implemented area and then only ESI registration in possible

Sir, I have a doubt, is it necessary new esi code for contract workers? Any problem arise in future, if we include contribution of contract workers alongwith permanent employees?
