Can anyone please tell me if someone's income is not taxable is it necessary to give form 16 B. I was working with one company from may 2009 to oct 2010. Now my current company is asking for form 16 B.

Shilpi,
They are supposed to provide service certificate wherein your salary details will also be mentioned. On request, service certificates are issued by the past employers. Aproach them with your written request.

shilpi, company will provide you a salary certifecate if your net taxable income is below the 1.8L /PA otherwise a form 16 is required if any TDS was deducted from salary.

From assessment year 2011-12 onwards salaried persons earning up to Rs 5 lakh per annum would not have to file IT returns.
The Form 16 issued to salaried employees will be treated as Income Tax Return.
The idea behind the move is that in cases where there are no other sources of income, filing of a return is a duplication of existing information.
So now if the salary is taxable and there is any TDS, the employer should issue Form 16.

Kamal
