Dear All,

I am in a great problem. I was working from October 2007 till September 2009. It is a very renowned company. I had to resign as they were transferring me and I could not go. It was such an exigency that I had to resign in one day. So i told in my letter that my notice period should be deducted from my leave payment.

Immediately after that I had a miscarriage for which I was under bed rest for one year. In the meantime my husband did a constant follow up. Even after all deduction, I was still supposed to a get a full and final amount of some money, my conveyance and telephone allowance. But when my husband went to get the FnF sheet, it is showing that there is a recovery of rs. 2800 but there are no calculations of the recovery. after one year when i went to the office, they said that they will provide me the documents with calculations. It is now 7 months that I am doing a follow up and they are not responding at all. I even wrote to the VP Hr in Delhi Corporate office. My full and final payment and PF is on hold.

I am very disturbed and really do not know how to get my PF and payment. Pls help me.

The company can only say anything about why they deducted Rs 2800 from your final settlement. Perhaps there may be tax pending deduction or profession tax till your date of leaving or similar issues. However, you need not wait for your company to withdraw your PF accumulations. You may submit the withdrawal forms, form 19 and form 10C, directly to the EPF Office after getting your signatures in the forms attested by your Bank Manager. Your amount will be credited to your account. While submitting the forms filled in complete, please enclose a cancelled cheque so as to ease electronic fund transfer by the EPFO.

I want to say that I have already submitted my form 10C and form 19 on November 2007 to the office with my husband. My p tax deduction was always done every month.
Now kindly guide what is the next step.

The forms you had submitted to your employer for onward submission to the EPFO might have been lost. Therefore, you may submit another set of forms directly.
Regarding your full and final settlement, I can only that that it is due to a bad HR practice that you are forced to suffer like this.

Greetings for the day,
First go through your appointment letter, what is conditions describe their for termination/resignation or notice period.If there is acondition to serve a notice of stipulated period either from any side, then only wages for notice period can't be deducted, if resigned with immediat effect then it should be on company directive either to deduct or not.
Secondly the deduction of Rs. 2800/- can only be confirm by HR-Dept. of the company if they unable to do so it is poor HR Practice truely tell by Madhu.
Thirdly ASK for Form 3A individual of yourself to confim that on what salary the EPF/EPS accumulation was done so that your salary can be known.
