Dear Sir, Our company was assuming that EISC was paid by the security contractor for his guards. But when we asked for challans, he told us that he has not paid any ESIC or PF for his company has less than 10 guards. Is ESIC/ PF applicable if contractor's employees are less than 10 in total? We have our own 40 workmen for production activity and guards for security are employed through contractor are 3.
Since we are principle employer we would like to pay if required to avoid legal hassel. Please inform can we pay last two years EISC on our behalf and if so what is the late payment fees or penalties or interest charged? Can we pay Online and if so what is the head under which we should deposit this amount as security agency doesn't have any EISC number of his own.

Yes ESIC/ PF will be applicable on the contractor's employees for the reason that your company is covered under the provisions of ESI & Provident Fund, it is the responsiblity of the principal employer to assure the payment of ESI & Provident Fund through the contract of principal employer themselve.
You are advised that pay immeidate the contribution of ESI & Provident Fund and later and/ or at the time of inspection, the department will ask to deposit the payment of damages and interest in respect of late payment of contribution.

You should be pay esic and pf from contractor because on the time of inspection you will be liable foe the payment and all damages , other wise your company will be black listed and case 7A will be chargeable on you
