I worked in the largest IT co for 3 years and then joined a start up in jan 2011 having 10 employees as the client and project is very good and the org had a very aggressive growth plan.
But after 3 months, i got to know the minute details about the org and the MD does not want to get more projects and hire resources(for reasons best not told here as they will take 2 pages).So,
1.The project will be over in 1 year and i dont know what will happen to me.
2. The promise they had made to me that i will be working as a Tech Lead will not be fulfilled in a long time to come.
2. I was promised that the headcount of org will cross 20 in 2 months after which they will creat PF accounts for employees, but now i dont see that coming in next 2 years.So i wont be having a PF acc in this org and cant transfer my prev PF amt.
3. MD is playing with salary for ex he deducted 34K in April as Tax for the complete year.But i know he does not deposit it with Govt but just keeps with himself.
4. Day by day he is forming new rules and regulations just to reduce the compensation every month.
5.The project will be over in 1 year and i can foresee no client will be coming after that.
In this circumstances, i do feel that my time and skills are getting wasted here, though its late and my skills are not getting enhanced.But when i am thinking of quitting the organisation, here are the troubles.
1. The MD will not relieve me.Though i can send a resignation mail, i am very much confdent that i will not get Relieving Letter and Experience Letter.
2. He last month sent an employee handbook which mentioned that resources cant leave org before completing 1 year and notice period was modified to 3 months otherwise employee has to pay 2.5L to the org before leaving.
When confronted (as these were not there in offer letter ), MD told that as an org he can change terms whenever required and send the Employee Handbook mentioning the same by which it will be in force from the immediate effect.
3. Though I will get more than 3 offers in 1 week, i can't provide the above letters to next org.What i can provide is Bank Statements showing salary credit, Salary Slips and Offer letter.
3. In the Background verification and refernece check, i am pretty sure the MD will give false and improper feedbacks/complaints.
So i am in a dilemma what to do in such scenario.Neither i am enjoying the job, nor confident about my future here, nor be able to quit it and jin any other org without relieving letter, experience letter.
Plzzzzzzzzzzzzzzzzzzzzz suggest me what i can do.Plz plz plz.

Anyways, coming to the point, you can resign from the company and demand for relieving letter, and seek the help of labour officer.
Whatever is mentioned in employee handbook cannot cause any problems for you if the same clause is not mentioned in Appointment letter. You have to clearly read the letter of appointment before taking any steps.
Take legal help, this is the right time to involve a practitioner who can take you out of this mess.
I'm sure your colleagues will also be facing the same problems, so you can give their contact details for background verification and reference check.
During interview for next job, specify the condition without much negativity to your next employer, I'm sure truth will prevail and you will land up a good job soon.

I second Archna, speak to a lawyer without any further delay. Your relieving documents and background verification can be held ransom, hence prewire that, asap! Before you resign, please understand maligning or de-reputing can be contested legally. Speak to the legal advisor in details, if required, understand what can be done to safeguard the interest of the employees.
The MD as discussed by you, appears to be insecure. Even if the business process might not be bleak, his behavior raises questions.
You have spent three months in the job. Make sure your fears are legitimate and have valid data if required to be substantiated. We are sure, you will be out of the woods in no time. Wish you all the best !

While agreeing with the opinions given by (Cite Contribution) and Archna, one can't help observing that the situations given in your mail have become quite rampant in the "organized" IT sector and clearly violates several provision of the Company Act and Labour Laws.
Taking recourse to legal remedies, seems to be the only feasible option, at this point of time.

Yes, Abdul i do acknowledge that i did take a wrong decision joining the startup but i did try to get all the information about the organisation before joining it, however now unfortunately it seems i missed so many vital negative information before my joining.
Abdul, there was a reason behind leaving the largest IT org after being there for 3 years and 2 months that is career progress, and i think it was not wrong.
But yes, the decision to join this start up comes out to be wrong.I joined it because of the project and the feedback from my previous leads and the people who know about the project was great and i can tell that i am quite satisfied about the quality of technical work i did in thin start up for last 4 months and the amount of knowledge i gained in this short span of time.Though i just came to know some days before that to from client itself that the project is going to be over in next 6 months and they are moving to other technologies and for that matter they will assign the projects in future to a new vendor.As per my info, the client has already finalised the new vendor.But this info was not shared to me by MD.
So one of my career ambition that is to lead a team of people is not going to happen here.
But the principal antagonising factors in my current org is the outlook and approach of MD towards the project and the resources like hiding facts, doing so many things that affects resources without letting them know and introducing new but wrong rules in the org without informing or consulting the resources who were hired without any of these new rules and clauses.
Hence, it seems i am wasting my time here coz if would invest these valuable time for some other org with long term projects, it will be beneficial for both the org and me in terms of the org's profitability, client satisfaction, resource reliability and my own career and goals.
I am disturbed of the indirect threats issued by the MD to resources because i think there are so many amicable ways to retain resources and encourage them to stick to the org without without causig any friction.
So i have thought about floating my resume in the job portals and to make it clear to the recruiting agencies/IT organisations way before scheduling interviews about the below mentioned facts.
1. I can provide the offer letter, salary slips, and bank statements for the
current organisations.But i can't provide the relieving letter/exp
letter as to get it,i have to fight a legal battle with the MD of current
org and i dont know when i will get it.
2. I cant provide the the reference of MD as he will not going to give the
right feedback and also any superior as i dont have any superior above
me in the org and i do work singularly on the project.I can give ph no
of colleagues for reference.
3. I can send mails from my official ID and client ID for the proof that i do
work in the organisation.
4. I will ask the new organisations to finish my background verification
before issuing the offer.
5. I can provide all the documents pertaining to my Academic
qualifications and my previous employment and can provide all kinds of
references for my previous employment.
6. The only issue with me is that i can not provide relieving letter/exp
letter and MD's reference but i can provide my resignation mail.
If these things are fine with the rcruiter then i can go ahead with the interviews.
Please suggest if my approach is correct as i am shaken after taking a wrong decision related to career which is hurting me like in hell day and night and difficult to know what is right and what is wrong.

1) Continue your search for better opportunity with BEST EMPLOYERS. If you get one, don't even dream to include this experience in your profile, as it will remind your painful past. Get in touch with BEST CONSULTANTS who can be of great help to you.
2) Since you haven't any signed agreement/bond with your company, though your current company had framed their own rules and regulations(policies) without the consent of employees, it will have no impact on your RESIGNATION. But, do cross check/evaluate clause mentioned in your APPOINTMENT LETTER and proceed accordingly.
3) Consult experienced LAWYER and FREE YOURSELF at the earliest. I hope there are GOOD LAWYERS in India who can teach unforgettable lesson to such MD'S.
4) You have all rights to disclose about your current organisation details including Mr. MD, in this forum. Lets educate every member of this forum about the DIRTY PRACTICES adopted by TOP MANAGEMENT.
I have no idea, who has given rights to TOP MANAGEMENT or ORGANISATIONS to frame their own rules and regulations and play games with employees future. Its a flimsy tactics found especially in IT INDUSTRY.

As i have got so many communication for interviews after posting my resume, before monving ahead i had a look on my offer letter and found out the below mentioned clause.
Clause 7. Service Agreement - As org will be incurring considerable expenditure on your training/initial cost, you will be required to execute an agreement to serve ORG for a minimum period of 1 year after joining with ORG, failing which, you will be liable to pay Rs. 2,50,000/- towards the training /initial cost expenditure.
If i will leave before completing 1 year, how this clause is going to affect me ? I posted this query in a legal forum and got a reply " LEAVE IF U HAVE GOOD JOB ELESE WHERE, NO CASE IS VALID IN THE EYE OF LAW ".But i am not sure about this.
A fresher who left the org 1 month back also told me the same as she is consulting with a lawyer in case MD files a case against her.
Plz share your views on the mentioned clause.

Since you are not a FRESHER, i hope this clause will not bind you to your company if you want to resign while meeting NOTICE PERIOD NORMS.
If you got the best offer, do join ASAP. Let me see to what extent your current employer is going fight for genuine justice.
