Q:- If any vendors or contractors not register his name in PF and esic dept.Then the principal employer take the all liability we are need some judgment of any state ? Pl. send me court judgment.

Dear Mr.S.Sethupathy,
I request you, if you have any judgment related liability of principle employer under EPF Act for engaging security services in his own establishment or sites.
My boss is not ready to accept liability of security service provider employees under EPF Act.
Please if you have the judgment and any correspondence related to security guards and principle employer liability under EPF Act then send me.

If the Security agency does not deduct the EPF or even it does not have a EPF code No to contribute, It is the duty of the Principal employer to deduct and contribute to the EPF for all elgilble empoyees.
This applicable not only for security services it applicable to all contract services under a principal employer.

I know the security services and all contractual employees are eligible to for EPF if working at principle employer establishment and having authority to principle employer to deduct the amount of EPF contribution from contractor bills and deposit in his own code no. but i required any judgment or any correspondence related to that so i can explain to them.
