Hi all seniors, I want to know in our company a worker is absent for the last 4 months and now he has come back and says I want to rejoin work. and time to time we had given him show-cause notices. and still now he hasn't given regulation. Can we terminate him? or if we need can we rejoin him as a permanent worker. please reply soon

No need to continue those worker who has habit to indiscipline. Cause disciplinary is necessary for amicable working condition.
however, as you said you have given show cause notice to him time to time. have you received any reply from him on your show cause notice? IF not, Immediately issue a suspension letter to him and fixed an inquiry Date. Make Committee include one Management Representative, One Suspended employee representative and one independent Authority (who is not part of Management or worker) Please following points should be observe before fixing any inquiry.
1. You take all Data/ Documents and record it( since joining to last day of his work and include his last 4 month absent Data)
2. Analyze his all activities during the work (Whether he was regularly breaching the company standing order or not)
3. Take all show cause notice that you have given to Him.
4. previously he was received any warning / show cause notice from management.
5. you have received any complain
Above point is very vital in inquiry table, Prepare a file and organize all the above details and start the inquiry. Before going to any decision give him appropriate chance to show his stand.
Don't give your decision on inquiry Table, after inquiry has been completed, give him time and convey the information and convey the same to local Inspecting authority of labour department.
