Good Morning to all.Iam working as a teacher in an international school. i joind in Nov 2010. and They are deducting ESI from Nov 2010 month onwards. Now iam availing the maternity leave from oct 10th 2011. Am i eligible to get ESI benefit?

Yes you will be eligible for the benefit under maternity benefit as you would have finished almost 11 months of contribution to ESI by then whereas the minimum requirement is as per ESI rule maternity benefit is available to a lady if she has worked 80 days before confinement. so no worries, u stand eligible. To be eligible for the ESI benefit, the woman is expected to work for not less than 70 days. Hence you can easily avail the ESI benefit.

you will be entitled for maternity leave if your confinement is after Nine months of your date of entry and in the returns from october 2010 to march 2011 no. days wages paid to be not less than 70.

ESIC Half yearly return will be submitted before May 15, 2011 and relevant benefit period will start by July 1, 2011. Hence you will be eligible for Maternity benefit. Still meet your ESIC Local office along with photocopy of the Half yrly return. Similarly while registering with ESIC Panel Doctor, talk to him about this, he will also guide you.
