Hi All,
I am working in a recruitment firm from Oct 2009. Now I have resigned from there and serving my notice period which is of one Month from 6th Jan to 6th Feb, 2011.
I had worked for a week in my notice period and then my employer said that he will take care of the things and tell me to work if there is something important. I just want to know will I get my full salary for the notice period, even if I was not asked to work.
Also I had received incentive for my 2 candidates in half, and half the money as per the agreement with the client is to pay after 6 months time after the candidate has joined, So 6 months time is not finished yet. But I want to know will I get the remaining amount of the incentive or not.
I have not discussed this matter as of now with my employer because still there is one week left for the settlement. But in Advance i want to know what is the correct procedure.
Please Let me know asap.

If the intention of your employer is to relieve you much before finishing notice period, except for layoff cases, company pay you till the relieving date only. Also make sure that you got a written acceptance on resignation. Also get your relieving date in writing
It is not legitimate for an employer to deduct notice pay from employee, when employee resigns and agrees to complete notice period. However get clarity on these aspects
"..and half the money as per the agreement with the client is to pay after 6 months time after the candidate has joined". I don't think employer is liable to pay this amount, because by the time it is due, you will not be an employee

Thanks for the immediate response. Got your point for incentives. But for the notice period part my employer had given acceptance in mail for the Resignation and for notice period he siad he will consider the notice period and help it in completing as well but this point was communicated verbally only. But I want to know the notice period finishes, and as per the full and final settlement part can he deny to pay my salary, as he did not ask me to work.

you are right Anita, As the employer dint not allow you to work on your notice period, i think they might adjust your avialable leaves(PLs.) against you notice period.In Full and final settlement they normally clear the dues for your available leaves as well as the last month or any pending salary. And might be in your case they will pay your salary bt will not pay the leave dues and will adjust against you notice period....But in most companies the rule is tht you cant take any leave during your notice period and you have to physically serve your notice period...I think you sld discuss these aspect with your reporting manager and then wiht HR once, as you dint have ny issue on serving your notice period.....
And ABout the incentive thing....As per compnay rule,i believe you needs to be a active employee of the same organization, when the reffered employee completes 6months.It also a reward forretainment startegy.

I would also accept the comments from gayathri & Consultme. But i would to seek a clarification from u regarding ur presentence (attendence) in the company. As per my knowledge there r two things to be considered:
1) Daily having your presence(attendance) in the company but not involved in any work.
2) Not attending ur duties (absence)
If ur current situation is option1 then its company reponsibility to pay u.

As mentioned two points both are correct in my case.
My attendence is there but not exactly doing the work as its is not asked. But what all updates, if any ,I have I report to my Employer as well.

Dear Tahini,

Copanies has kept notice period to handover your responsibilities to other employee and this can vary according to your responsibilities, as some lower grade employee have to serve notice period from 15 days and for senior employees has to serve for 90 days also.

If your notice period was for 30 days and your senior has releved you before 30 days that means he will adjust your remaining notice period days from your leaves.

If you have resigned, you are entitled to get Full n Final settlement counted over last working date. Leaves can be used just to complete the notice period, you can not encash them after resigning. So for example you have attended your office for 10 days, you will get salary for 10 days only. Seniors releave thier employee before notice period, just to reduce cost.

Different organisation has different format for incentives (Monthly, Quarterly, Bi-Yearly and yearly). But while they give incentive, the employee should be in active stage. So you can not get the incentive once you have resigned.

Dear Anita,
if u r going on regular basis like u used to go before resigning, then u will get ur full salary. doing work or not while u r inside the office is a different thing.....main is ur presence not work at the moment...........
secondly about ur incentive chances r there that ur employer will might give it or not..............that is upto him.............if u hv anything specific regarding the same in written then share it...............

Hi Anitha,
You will be paid Full & Final amount from your Company. Don't get tensed. Now its your responsibility to hand over the assigned task & train your alternative employee (The person ready to take ur responsibility on behalf of u) seriously & sincerely.
