I have been contributing to EPF for 4 years and 8 months through an employer. Now that I switched my job to another employer who does not deduct any PF as the employer can decided not to deduct PF if the basic salaries of all the employees are more than Rs 6500. I thought of transferring my PF from previous employer to current employer so that my PF account wuld have been more than 5 years, but came to know that my new employer does not deduct PF only after joining :(
I have been going through various posts which says that PF account with continuous contribution of 5 years and above will not incur any tax during withdrawal.
Can someone help me out with suitable steps to withdraw my PF from my previous employer without incurring any tax?
Thanks,
Balaji

Dear Srikanth,
Ours is an exempted Trust and here I never experienced IT deduction on PF.
To get exemption, equal or better benefits should be provided to the members. If IT is deducted exclusively for PF Trusts this will be violation of the above policy and injustice to a faction of PF members.

Dear Sreekanth,
198133-pf-pension-amount-premature-withdrawal - pls search for this topic
please go thru the above topic..i see that TDS is deducted by PF Office...
if the new company is not deducting Pf, its not employees fault, so can we substantiate it and get the TDS refunded ??
Thanks

dear brmalingam
in case you have been contributing to PF in your earlier employer and are still working with another employer who too is covered under the Act, you are verily entitled and liable for provident fund benefits.
Wait for the time, sooner or later if it is realised by the PF Enforcement officers, Ast. Comm, your entire contribution together with employers share shall be recovered from your employer.
from your point of view, you could address a letter to the present employer clarifying that you have been a member of the fund in earlier employment, cite your pf no,. and mark a c.c. of the letter to the Asst. PF COmmissioner (Compliance) of the respective Regional / Sub Regional EPFO from where your present employer is covered
thanks and regards
