Dear All,
one question from my side regarding confirmation.
one employee joined in our organisation in Manager-grade.
after six months he got his appraisal form for confirmation.he is recommended for confirmation.
After Two days again he was called again and unit Head asked him to sign another appraisal Form saying him that Managment want to extend his probation for three more months.First he rejected and then he signed another form.
after threemonths he not got his confirmation letter.
now he completed one year service.then his services will be confirmed or not.
inbetween he got increment also.
please clarify the issue with details.

Hi,
Kindly note the following.
1) The conditions in the appointment letter regarding this need to be read. If it says that unless the employee is informed of his/ her confirmation in writing , he/ she continues to be on probation, then this manager you are talking of continues to be a probationer.
2) However the very fact that he has been continued for more than a year and having been given increment clearly indicates that he is confirmed. The non issuance of the confirmation letter becomes immaterial. (I also presume the probation extension letter was not issued in this case).

Can anyone tell me that , After Confirmation of an Employee , Salary should be raised or not???
From India, Pune
It is not mandatory to give salary hike along with confirmation. Generally companies attach all their employees to the nearest appraisal cycle.
However, if the organization is small and management is keen to retain its current employees there is definitely nothing wrong in giving salary increase.
Just ensure certain broad guidelines are laid down, understood and signed off with management to ensure consistency and parity.

Thanks Dayanand Sir!
In case after getting confirmation letter the employer has not given further letter at the time of raise/increment implemented and started paying raised salary, is there any scope to Notice Period (Notice Period for myself is 3 months or otherwise amount equal to salary of 3 months whereas the Employer has kept just one month or amount equal to one month only from his end)

Hi,
I understand the issue as follows.
The salary increment has been effected and there is no letter indicating the same.
However the consistency in the rise ( to show that it was not one time payment) can be seen in the payslips every month.
The original letter of appoint with its notice period clauses has to be referred for the notice period.
If subsequently a revised letter with new terms of notice period is issued then the same holds good.
So what ever has been communicated recently stays - in your case employer having one month notice period and your claim of three months has not been understood properly.
Kind regards
Dayanand
