Dear members ,my company want to hire contract labour through contractor.
Please tell me that what is "A TO Z, ALL procedure" to hire the contract labour.
what formalities we have to complete,what returns and when we have to send and where,what records we have to up to date and maintained,please please give me all details about this.

steps

1.Enter into written contract with the contractor for a specified period liketo start with for one year. Mention in contract the manpower required, type ofwork/areas where contract workers will be engaged and the rate of wages to be paid to contract workers and duration of contract.. If the work is on piece rate basis, mention the tonnage to be handled and rate per ton of material.

2. Go to office of commr. oflabour,Delhi and ask to the vendor- form for registration of establishment and form for licnece to contractor.

3.As a employer you have to fill details in the Registration certificate format.

4.Ask the dealing clerk as to what fees is to be deposited.The fee is based on no.of contractor workers to be engaged. Ask him for the challan,through which the fees is to be deposited either in Reserve Bankof India or in treasury.( THe challan will be filled in by the dealing cclerk and you have to get signature of the concerned labourofficer on that challan, before depositing the same in bank. Once the challan is endorsed by the Labour officer you have to ensure that the same is deposited in bank within 48 hrs.else you will have to get a fresh challan.

5.The RBI will return you one copy of the (3 copies) challan. Take the xerox copy of the receipt challan copy. Attach the Original receipted copy to your application for registration of establishment.Retain xerox for records.

6. You will get a certificate ofregistration of establishment from Labour Office within 15 days.

7. The Employer has not more things to comply,He has to send only one ANNUAL RETURN by 31 Jan.of following year for the previous year i.e. from start date/month of contract till 31st Dec. (in the first year) and subsequently formJAN-DEC period. If the contractor is discontinued in between, the Employer has to inform the Labour deptt of the same. If new contractor is taken in place of earlier one, the employer has toapply in the same format (requesting for amendment of registration)( if the number of contract workers are same as that of earlier contractor no addl. fees is to be paid.

CONTRACTORS LICENCE:

The contractor, if he is engaging mroe than 20 contract workers, has to fill in application for Licence. He has to attach with his application- Regn. under shop Act or House tax receipt(if operating from home)+ copy of agreement signed with Employer+ Copy of Insurnace coverage + requsitie fees. ( In most of the cases to get the licence early he has to do SEWA.)

The EMPLOYER has to ensure that the contractor comply with provisions of contractor labour act religiously. The contractor has to maintain following registers.

a)Attendance cum wage register. (all colums are to be filled in religiously)

b) Register of workers- containing personal details ofall contrct workers

c) attendence card,( all entries are to be duly filled in)

Leave register, leave card,identity card

d) records ofPF deducted and remitted, paid challans, 3A, 6A,12A Statements

e) record of ESI Contribution cards,ESI Paid challan and annual returns /compliances

f) paid challan of service tax, professional tax.

The employer has to ensure that if the industry falls under schedule Industry in minimum wages act, appropriate min. wages are paid to contract workers. Nowadays the admn.(lab. dept) isvery strict. They directly file case against you in Labour Court.

Most important: Please ensure in every month that the contractor has paid appropriate wages, deposited PF/ESI/Prof.Tax/Service tax.and get xerox copies of the same for your records. Else the liability will be of Principle Employer)
