Dear Seniors,

I am working as HR recruiter in a placement firm. At the time of my interview, they asked me to join on an urgent basis as they were abt to start bulk recruitment drives and said that they'll give the offer letter after 2-3 days.Since I was free at that time, I joined them.They didn't give the offer letter till 3 months, although I reminded them time to time. I was also becoming uncomfortable here coz frequently they made us do too much overtime, usually 2-3 hrs extra daily and did'nt pay us for that. After joining I came to know that there are no fixed norms for the variable pay also.

At last, they gave me the offer letter and asked me to sign a copy of it immediately, but I opted to read and understand it carefully, and when I went through it, I felt a bit that this is not the proper offer letter. Before signing it, I would like it to be read by you experienced people once so that I am convinced that this is the standard and justified agreement.

I am attaching the copy of the offer letter, kindly go through it and advise.I would also like to mention that there is no other document, not even the appointment letter provided to me by the company.

The compensation part in "Rs 9000/- to be paid in arrears" is something of concern. Ask them for a proper break-up in written. How much is the fixed monthly salary and how much would be the variable. Hope they have discussed with you your targets to acheieve the variable pay. Apart from that, there isnt much to read in the offer letter. Needless to say, if you are not content with the work and pay, then look out for something better after careful judgement.....Regards SS

1. "in arrears" seems dubious straight away. i feel they would be blocking part salary and/or incentives as arm twisting till the entire course of employemnt.
2ndly non poaching of employees or clients for two years may also be used against an employee when they leave.
i have personally seen an instance of a cos in delhi wherein two different people have refused to join in the same state.

Thanks a lot for ur response.My fixed salary is Rs 9000/- per month only, which is paid in cash.As far as the variables are concerned, they had said at the time of the interview that there will be no variables for initial two months and after that, the slab for variables will be discussed with me and decided, the reason behind that was told that the slab for incentive will depend upon my performance........now I am about to complete 6 months here and I've reminded him abt this many times during this time period, but he is not giving me proper response, and he even got irritated and said that he will himself call me for the discussion and I am no more supposed to remind him of this.............I am really in frustration what to do...

Option1: Look out for another better job
Option2: Stay where you are hoping that someday sometime someplace someone will notice you and give what to deserve.
Are you really a good performer and have you really contributed to the firm you are in??....Analyse your standing in the firm vis-a-vis other employees and the job that you do. If yes then show them the data of your performance and ask for a discussion...if not then better stay quite till you perform. In any case, dont leave the job to find another, bcoz the job market is really tough to crack amongst competition. So keep talking to people for openings and plan accordingly. Telephonic rounds should help you out. Incase your are sure of better deal then go ahead.......Regards SS

Dear All,
I am performing as per their expectations and they have made me work without incentives, and earlier when I reminded them regarding this, they gave me an indication that they will not give me the incentive for my past work, which is pending after 2 months of joining.The delay in the discussion has been done from their side, and I feel greatly frustrated, depressed and insecure now working in the current situation of uncertainity, as I really don't know what they are up to.They have strictly instructed me not to approach them for the matter again, until they approach me.........I don't understand how I should approach them. Since they don't keep their word, is it correct to believe their verbal discussion...??

Since they have instructed you not to approach them regarding this matter, so now the battle lines are clear. Either you have to wait for their response OR you have to take initiative of looking for another job. But all this depends on really how good you are at your job in the first place. If you have the confidence in yourself that you are better then what they think you are, then go ahead bcoz the world is full of opportunities. Only a note of caution while looking for new opportunities, when you get through always check out if this a bait in disguise. Be more specific in future about what you want in the intial stages itself bcoz thats where your voice (if) is going to be heard....maybe my views might differ from senior coz i m not a senior.....regards SS

I agree with you, even I have realised that I am being exploited here and I was wrong by simply trusting their verbal discussions before joining, of which they are taking advantage.......I am very disappointed by their behaviour and am looking for a change, but the point at this time is.......should I sign the offer letter and give to them? As per my opinion, I don't feel it should be done and there is no sense coz they are not ready to discuss regarding the matters. Another thing which I doubt is, in future, should I trust on the verbal discussions at the time of the interview or should I ask them to mention all the points which have initially been decided in the offer letter or appointment letter...?? I mean what should I ensure in the future so that such things are not repeated at any other workplace..??
Other respected members, I request you to also give your opinions, as I really need your guidance......please!

Well if the clause "Salary to be paid in arrears" still stands out in your offer letter and your employers dont want a discussion on the same, then the only option is to sign the offer letter and take it for records bcoz it will be required by you for proof in future employment. Hope you get your pay slips too. Keep all the records and then decide if you want to show them to future employers (else you can show your bank statements). Nothing works in Verbal in this world. Infact even written is challenged. In Future, Get all your legible things written down in black & white, else history will repeat itself. I have myself been a victim of verbal commitments in past and its as good as no commitment at all. Hope its clear. If you have the confidence on your performance & skill set, I dont think it is very difficult to get your way during job negotiations......rgrds SS (not a senior nor a junior, only practical!)
