hi, i have a query tht apart from qualified employees, even the office boy, and security guard, floor cleaner etc, will have the PF, ESI deuctions?
if yes, what is the % of deduction from basic salary,?

I believe by qualification you mean academic or technical qualification. If so, all employees, irrespective of their educational qualification are eligible to become members of EPF and ESI. In fact it is meant for such less paid employees that these social security measures have been framed. As such, it is mandatory that all employees whose basic salary are less than Rs 6500 at the time of joining are the ones who are eligible to become members of EPF by statute. Similarly, employees whose salary exceed Rs 15000 are out of coverage of ESI schemes, which implied that ESI scheme is meant for low paid employees only.

yes im totaly agreed with Madhu T K, in fact all the labour law’s main purpose is to provide social security to Less paid and deprive people. regards,

All employees if covered by the eligiblity crite area shall be entitled benefit under all social welfare legislations like PF, ESI, Gratuity etc. irrespetive of there qualification.

Esi contribution 1.75% from employee and 4.75% from Employer side.
If employee is getting less then Rs 50/- per day than total 6% will be contribute from Employer side no deduction will be made from Employee side.

please note that from aug 2008, the amount of rs. 50 has been increased to rs. 70 per day. those who are getting a daily wage of less than rs. 70 need not have the pay employee contribution for esi.
Also please note that the employer contribution is 4.75% only.

Can I put a correction to Visheshgopal?. Employees contribution to ESI is not to be deducted from the wages of employees whose daily average wage is not more than Rs 70 and not Rs 50. The employer's share in such cases will remain the same, ie, 4.75%.

hi madhu,
i think in every state the minimum rate of labours revised, in my state(Orissa) the un skilled labour rate is Rs90/- daily so ifeel if any one providing 50 or 70 rs/- that mean he is doing unfair labour practices.
Did u receive the amendment of revised esi slab from 10,000 to 15,000 ?
if u get kindly post it becaz till date i have not received
