Hi every body kindly clarify the meaning of person under maternity benefit act 1961 for applicability of act. is 10 female employee or any 10 person including male? since it act and benefits apply on femalehence i m not clear.
Kindly also inform what are the conditions in which employer can go for Workmen Compensation policy instead of ESI? if all employees are drawing salary higher than maximum limit of ESI applicabilty (Rs. 15000/- in present situation) employer need WC policy if no, than in case of accident or death who & how payment can be made or no payment is require as per law. kindly clarify and send mail me on my mail id

Maternity Benefit Act is applicable to establishments irrespective of the number of females employed. Therefore, even if there is only one female employee the Act will be applicable and she will be eligible for maternity benefits.
Application of Workmen's Compensation Act takes place automatically. Only thing is that in respect of employees who are covered by ESI, the obligation to pay compensation in case of employment injury etc will be on the ESI Corporation and not on the employer. On the other hand it becomes his responsibility to ensure insurance cover to the rest of the employees.
