Respected seniors,
I m working with retails firm as a Admin and HR officer and one of my employee is not reporting without any kind of information but I have come to know from his friend that he have joined another organization, he have not given resignation in our firm, so can we send him legal notice for the same or can we terminate from his job
Please suggest me how do I need to handle this situation

Sending notice to an employee absconding from work depends upon the position of the employee. If he has been holding a responsible position you can send him a notice and ask him to report to duty. On the other hand, if he is a worker category employee leave him by terminating service. However, to be of safer side, send a formal letter stating that " You have been absenting from work since..... If you do not resume duty within 2 days we will be constrained to terminate service treating that you are no longer interested in the job".

Dear Sir,
I have one more question to ask. One of my employees has given the resignation just few days back and he is not reporting to work while asking he is saying that he is on leave as he has comp off to utilize
My question is can some can go on leave during the notice period. If no than why and some will go on leave without approval than what is action to be taken against the employee

Well, make it clear to your employee that any kind of leaves are not permitted during notice period and if he's still not listening you can give a oral warning. Probably make him to wait to get this relieving letter.
