In my company there is already registered one contract labour for the house keeping, as per contract act we are filling returns to the labour office with mentioning the above contractor. Now we have hired 6 to 8 labour from the outside for the civil work just for ten to twenty days work, my question is , should we have to mention this hired person in the return ?

Hi,
You can not engage contract labour without a licensed contractor whose name is listed in the registration certificate granted to you by the Labour Dept. If no civil contractor is listed, make necessary ammendment in your registration certificate by getting him enrolled and then engage contract labour through him for civil work. Filing return is statutory obligation on you part for all the contract labour you have engaged.

We are a sub contractor for manpower outsourcing, in this case who will sign in form-V, whether the main principal employer or our contractor/our principal employer.

I am sure only the Principal Employer. Labour force can not be claimed by two organisations ie contractor and sub contractor. I have case, the principal employer has given permission on for V to main contractor and the contractor managed subcontractors. Against RTI, the Principal Employer expressed that he is concerned with Main Contractor and not otherwise.
On the other hand, I found Labour Officer was suggesting main contractor to recommend license for sub contractors. I do not know the reason. But, it is only one that is Principal Employer.
