Leave rule is usually made by the respective establishment and included in the Standing Orders. However, Factories Act (as also the Shops and Establishments Act) also provides for such number of leaves as applicable to the employees in the factories. As per Factories Act, only one kind of leave, ie, Annual Leave with Wages (Earned Leave/ Privilege Leave) is the only leave available. As per the said Act, an employee who has worked for at least 240 days in the previous year shall be eligible for leave at the rate of one leave for every 20 days worked in the preceding year.
As stated earlier, an establishment is free to give any more leave of any nature over and above what is provided in the Act.

Dear Member,
This is to inform you that the Factories Act, 1948 do not have any provision relating to grant of SL & CL. If your unit is covered under this Act then plz go through your applicable State Industrial Establishment ( National & Festival Holidays and C & S leaves) Act for having knowledge on statutory number of leaves to be granted to the employees during the year. If Industrial Employment ( Standing Orders) Act, 1946 is applicable then go through these S O regarding grant of Sl & CL.

Sir,
PL is as said above depends on the FActories Act,1948 where as the SL and CL are dependent on org policy/Standing orders. If the organization is covered under wage board such as cement wage board then as per the wage board the CL and SL to be alloted.
