Hi,
We are engaged in Computer Embroidery Jobworks and Normally cater various Domestic Market as well as Exporters.
We have 8 employees and 3 family members in the production process and we are technically skilled enough to manage the whole operations ourselves.
The Employees keep on changing once in two-three months.
We would like to know how to claim exemption from ESI or if there is any other way we get Clearance from ESI.
If there is any body who can guide us we will be thankful.

Dear All
ESI act applicable in power use upto 10 employees and non poweruse upto 20 employees. You have computer emb machinery. So, when you have 10 employees , then you will applicable in ESI .

Dear Sir, I would like to know if our area in not shown in the implemented areas of ESIC then how we can get exemption from ESI ?.

1. Sir, if the area in which your unit/establishment is located is reported not in implemented area, then I think, it is not coverable at all. However, many times, it is lateron found that the area is actually notified under section 1(3) of ESI Act, 1948.
2. Therefore, in order to avoid any doubt and discrepancy, it is appropriate if you may contact the nearest office of ESIC and ascertain the position before presuming that your unit is coverable or not-coverable.
3. The procedure for exemption is mentioned in Chapter VIII of the said Act.
