Dear All,
If a company is registered under Shops & Establishment and its offices are in different states of India and all offices are registered with Local offices under Shops & Establishments itself. The company does not have more than 5 staffs in any of the office. But they have 5-9 contracted employee but in total does not having the capacity of 15 employee including contract as well. Does the company should registered with Labour office. This rule is varying in different state or not.
Pls advise with the copy laws / notification if available with you.
Pls help me to come out from this.

Dear Santosh,
According to your brief you are running different offices at different places & as such you are not doing any manufacturing activity. You have already get registration certificates for your different offices from different States of India. I do not thing now you are to get any further registration from the Labour Office but you are to be careful for these R Cs in connection with their renewal. You have also not clarified your doubt about the registration from labour office. If you are having less then ten contractor employee/workers, even then you are not required to have registration certificate under the Contract Labour (R&A) Act, 1970.

The appropriate authority under the Shops and Establishment Act itself is the Labour Officer. That means, if you are covered by Shops Act, you are required to get RC from the Labour Officer ( Asst. Labour Officer as per Kerala Shops and Commercial Establishments Act) and the same is the licence to run the establishment with at least one employee. No more registration is required.
If you employ at least 20 employees through a contractor, you have to obtain licence from the Labour Department as per the Contract Labour ( Regulation and Abolition ) Act. Since you have less than 20 contract employees that also is not required.
