Hi, One of my fds have started up a s/w development co., But now he sees that many of the employees are resigning his co. and joining the client's co.
Can someone help me out with how to come over this issue?

My friend already have an agreement with client already which says the client cannot absorb his employees for the nxt 3 yrs, but the issue is my friend is a small co. and the client is huge..he cannot go legally against client.
Is there anyways where we can bind the employee without moving???

1.Best thing is employee satisfaction ( give comp off, no dress code, work at home options,give responsibility, talk to them on weekly basis appreicate the existng employees)
2. Tell that company will reward those employees who stay with you for more than one year.
3.Sponsor key team members for some training and sign one year contract .
4. Make each and every individuals are leaders in the company no hirechachy should be there.......
5.Identify groups and demolish groupishm.
6.Have a transparent company policy.....
7. Try to give work to talented employees at home when client visits your company.
8.Your company policy should be no employee can contact the clients with out your approvals.
9. Make policy for 2 months notice period or the employee has to pay the dues.

I am working in a company. One of my client company has approached me and ask for one of my employee who was working onsite at his location to be absorbed in his company.
I have an agreement with employee that he cant work with client company for 1 year post termination of employment.
What shall I do ?
can client company hire him without my consent
