Hi seniors,
I am facing a problem. I am working with a company for the last 3 months.
The job profile is not what i expected when i joined. I was told it was a technical post but now i have to do sales also. I am constantly in a bad state of mind. In the meantime, i got an offer from a good company with better compensation and a better post. Now my existing company came to know of that and are threatening to make my life hell and file legal and police case against me for cheating. These are people who have good hold in our industry. Now i am faced with dire problems. i am unsure of my salary for this month as well as my candidature for the new company.
In this case what should i do?
Do i abscond after getting the joining letter from the new co?
I am not getting my salary in any case. what should i do?
If i go, what legal or police action can they take? i have not signed any bond or contract.
Please help me out. Your prompt reply may just help me get out of this soup.

Hi,
You seem to be desparate. I dont think there is a need to get so desparate. Just serve the notice period and leave. If possible take ackonwledgment on it. I hope u are not the first employee in the Company to leave. Well regarding there hold in the industry, if they are so high profiled will they have time to screw ur life............... and within 3 month have you become so important........

Do as per terms and conditions of your appointment letter.
Make sure, no company assets are in your possession as per your company records.
Since the present company have influence over the industry, do enquiry, if they have any influence on your new company. Inform your present situation to the new appointment authority and see that you are safe in the new place.
If you feel that all are OK, then proceed.
Otherwise, since the present company have good influence over the industry, then try to get job profile as per promised and better compensation.

you have just serve for three month u might be on probation.
if you are on probation and what about notice period.
if you are required to serve notice than they can deduct notice pay from your salary.
you not done any cheating and you can leave sevice they can
not do anything.what police case they will file agaist you.

Thanks everyone for your reply.
Now to answer all your queries.
Divya: There is no notice period mentioned in the appointment letter. the co. just terminated a colleague last week without any notice and compensation.
I am very important for them because the software expertise i came for, there are no other individuals in India for that.
parasurampur: There were no terms and conditions mentioned on the appointment letter.
I already had a meeting with the new co. and they are Ok with all the things. I have informed them about the current situation.
Mr.Malik: Thanks for your inputs. I am not on Probation. I was hired as an expert in a particular technology that only i know in India. I was appointed on full payroll. There are no conditions mentioned in the appointment letter. Thanks again for the reassurance about the police case.

Dear please dont panic nothing will happen you are on probation so serve as per the appointment order .No police case can be filed you should just inform your new company about your current proceedings but i suggest to do that after getting the offer from that company.As all the concerns do verification of our experiences and background its better we inform the concern about our past.you can mail me to my personal id 2.My id .

Many companies does they just cover up sales job. You could have spoke with those who already employed over there... Give them some personal reasons to leave the job.. better handle this issue with some known person in this industry.

Wait for until you get your salary if you have not singed any contract with them,They can't take any legal action if you are very neat,sincere & clean on your attitute.
Dont worry on this,please take some times from your next company and give your resignation on a proper manner.
We have good link with labour commissioner in most of the cities,please let me know if some mishappening you notice,i will contact to your boss on this,all Indian citizens with you now.

I think u r in thairt. If the offred company has no objecion form your back ground I mean If your finaly selected ust collect the offer Latter frst. If u r in notice Period You ca serve for that period other wise U have to pay in lue of that only. The have the Right to Recover this part only.No one can do any thing apart from this ,So don't fear. Nothing happen if you leave company immediately when your appointment has no expression of termination clause.
You employer is bad company. leave them immediately and no police or court can entertain them if they intimidate employee.
