Hi Seniors,
I am Neha establishing a HR Department in my company, i know that CL and ML should be six in a month and PL is to be given 1 for the 20 days. Now i would like to ask that CL, ML lapse after a financial year, so what about PL. Is it to be carried forward in a calender year or a financial year???? Please let me know................???

Dear Neha,
You can carry forward both your EL and SL but not your CL. EL and SL are calculated as per calender year.
One more thing, there is no such established rule that CL and SL should be 6 per year(not month). It varies from company to company. EL (1 for 20 days) is only something which is stated by law. But if someone tries to give a better benefit then the law then they are most welcome.

Generally Casual Leave, maternity leaves are not allowed to be carried forward as it pertain to that year. However, its a company specific policy. In my Comapny staff is allowd to carry forward Sick leave, Casual leave and Previlage leave and only sick leave and Previlage leave for exective. All said and done, there is a cap on maximum leave that can be accumlated. Further there is a limit on the number of leave that an employee can accumulate in a year.

First decide that in which of the act your establishment is covered i.e. under the State Shops Act or Factories Act & then go through the provisions on leaves. If your unit is covered under State Shops Act then you can see there all the provisions on grant of EL, CL & SL. If your unit is covered under The Factories Act,1948 then for EL plz go through the Chapter VIII of the Leave with wages & for CL & SL you are to go through The State Industrial Establishment (Casuel & sick Leaves and National & Festival Holidays) Act.
