Pls clarify my doubts regarding Form 16 issuance.
1. Can we issue Form No 16/16A without PAN details of the deductee for the financial year 2008-09, few deductee are not having PAN information.
2. If we issue the Form No 16/16A to the deductee without mentioning PAN details is it valid or not as per Income Tax Act/Rules.

I presume that the TDS Deducted for all those such employees must have been regularly depostied with 'PAN applied for' status.
Form 16 can be issued without PAN no and the emplyee must get the PAN no. ASAP and file his/her return on the basis of Form 16 he/she has recieved.

Thanks for your prompt response Saurabh.
But my doubt is the employee would not be ablt to file the IT Returns using the Form 16 without PAN, and the employee's name will not reflect in Form 24 Q. So, the employer will have to face legal disputes if form 16 is issued without PAN, am i right ? :-?
