Dear Sir, We r Co.Op. Bank, My question is, In Co.op. Bank employee security guard with Gun serving Bank since last 10 years, Pl. advice us the timings of the above employees upto maximum how many hours Bank can take work from them entire day. pl reply ....'

For any one irrespective of their position it will be 8 hrs / 48 hrs only the thing that you can pay oT for the remaining hours but my advise is being a bank it is better to deploy the guards for only for 8 hrs otherwise there is every chance of people get tired and unable to concentrate on their works With best regards - kameswarao

Thanks for prompt Reply Sunali, But we r taking 12 hours duty from our permanent Gun man / Security guards, Now they r demanding more pay or less duty hours So. what is the labour Law says in this particular things. Thanks in Adcance.:icon14:

It is better to reduce the hrs and have an extra person who also works for 8 hrs. 12 hrs of working reduces the efficeincy level why pay extra stick to legal grounds. Sonali

Thanks again, But my point is we r giving all financial benefits like (2 Salary for Closing day (Bank's financial closing allowances) , Bonus and festival advance) but these are not mentioned in standing letter (Service Letter) and closing allowance and bonus are not his rights but as per Bank's practice they are getting all this things , So can we reduce Closing allw. and bonus from his benefits and it is also not a part of his salary packages pl. reply ... Hi Mukesh, As per the labour law, 8hrs duty per day / 48 hrs per week, is what is the norm. The additional hours can be given as OT. But in practical terms, security guards do duty for 12 hrs. Hence it will be the Boards decision on how it has to go about it. As per the labour law, you cannot reduce Bonus , as it is a legal compliance. Whether its mentioned in the Service Letter / Appointment Letter or not. As the Bank is giving closing allowance from its side, the board can think of reducing it. As its a Bank and is always at risk, it is adviciable to have duties for 8 hrs per day, so that the security is not fatigued and can concentrate on his duties. Dear Rakesh, I really appreciate your prompt reply, Rakesh further, I need some clarifications on same subject, Sir, We have appointed security arms guards before 10 years back, ours was newly opened Co.Op Bank Ltd., since then the above guards was serving Bank for 12 hours per day, the appointment letter and Bank's rules were silent about working hours and he was doing duty for 12 hours till date, getting two closing allowances, our all other staff is not getting any short of overtime as and when Bank requires late hours work in the Bank and all staff are getting two closing allowances in lieu of overtime i.e., Two salaries per annum. In light of the above now he is claiming overtime beyond 8 hours duty. Please guide us should we give 8 hours duty order by giving fresh order by not giving two closing salaries to him or other alternate way. Please guide us for the same ...

Dear Mr Mukesh, I think you should definetely go through the labour laws and minimum wages act applicable to your state. I have been in the Industrial security management for almost 10 years. For every 6 days there has to one day off as per the rules and there are elaborate rules and regulations concerning to every trade as per the minimum wages and labour Act. With regard to the employees working hours it is mandatory that the minimum working hours is 48 hours per week / 8 hours per day irrespestive of trade an employee is working for. The other welfare measures you must comply with your management people and in consultation with the policies of top management. Also we do not know whether they are your own employees or outsourced one. Regards. V. Rangarajan.
