Hello Everyone,

I am surej. Presently i am working in a small software company in bangalore. I have been working with this company for the past 1.2 years. I have a bond agreement with the company. The bond period is 2.5 years and if i breach it the bond amount is 1.5 lakhs. As part of the bond,i have given my consolidated mark list with my company is holding. I was a fresher when i joined this company. Therefore i wanted the job very badly and accepted the bond agreement. I have been offered a better job in an MNC. I wish to take up this offer and proceed to this new company as it is better aligned with my career goals.

I initiated my resignation from the present company by first sending an email to my immediate PL and TL. I have a copy of the email with me. With regard to this, i talked to my PL and he insisted that i remain in the company and that its difficult to relieve me. I have discussed the situation with my parents and they are ready to pay the bond amount. So i told him that i am ready to pay the bond amount as part of the damages that i might cause while leaving the project. Now he told me that there would me a meeting with me on friday regarding this issue and that i rethink what i want.

I will be giving my official resignation letter in writing during that meeting. The bond agreement that i have signed is very clear as to what happens when i break it. But my PL indicated that it would be difficult to relieve me from the company and the word that he used was "tough".

My new employer requires my relieving letter from this company. I wish to do things in the right way. Also i am willing to train a person in my work area. I am trying to be as professional about this as possible. I wish to know what my options are if my company doesnt provide me with a relieving letter. I hope that someone will read this and provide me with some advice.

I appreciate the way you are trying to be professional. I think why dont you try discussing with HR of the new company you are trying to join about the non-availablity of Relieving letter and ask for some other alternative. He might give some other options too..

You say you have signed an agreement for 2.5yrs and and also accepted the conditions in case of infringing the terms of contract.
The company will have to consider your benevolence in paying the damage amount in case of breach. Also, you claim that you are ready to find a replacement.
I suggest you talk to your immediate supervisor in a calm manner and also convey that from the date of resignation, you would serve atleast two weeks in the company. Futher, the management would decide to discount the money which you owe to the company towards the agreement made. I am sure the management would accept to these and can be resolved with ease, if put it in a right manner.

Thanks for the quick reply. Thanks for supporting me. When my HR interview was conducted with the new company, the HR was very specific that they need the relieving letter from the previous company while joining. I am not sure whether they will allow me to join the company without a relieving letter. What options do i have my present company refuses to relieve me from the company even if i am ready to pay this bond amount?

I need a job. I am ready to give bond also.

I have similar situation,I am currently working in a pvt ltd IT company.2 days back I gave my resignation.my reporting manager acknowledged my relieving stating that from his side in issues to relieve me .but hr is not willing to relieve my .she send a mail saying
"First of all, we need to find a replacement since you are in a senior position..
We want you to give a proper KT to the new joiner and then leave..
We would relieve you only after we find a better & suitable replacement..
This is the mail HR send.There is no hard rules written for notice period also...."
I have to join in a new firm,since current company not confirming my relieving date.
Please somebody help me..
