Hi could any one tell me what is the difference between dismiss and discharge. Mantu71

Discharge refers to termination of service due to any reason including retrenchment after following the provisions of Industrial Disputes Act. An employee may be discharged from service for misconduct after holding disciplinary action. But a discharged employee shall be eligible for unpaid benefits from the company. On the other hand, dismissal is made for such gross negligence, the gravity of offence is beyond tolerable. An employee dismissed will not be paid gratuity and unavailed benefits. In case dismissal is made after the employee having convicted for murder, the PF balance shall also be suspended. Regards, Madhu.T.K
