One of my staff has been absent without authorization since one month and has taken money for office work as well which has not been completed. He has also taken official mobile sim card and not returned the same. We have now learnt that he has taken employment elsewhere. A registered letter has been sent to his residence asking to explain his absence and other issues mentioned here for which no reply has come in as yet. What is the course of action recommended in this case?:(

Dear,
simply Hold his full and final dues check it first. If he had taken ur mobile sim and if the sim is on company record first file a complaint in police station that's ur right and it is due to this terrorist attack.

Thanks Amit for your suggestion. His sim card was on company family plan for which the company had applied and paid deposit. Subsequently his number was changed to prepaid plan on his name (as vodafone needs the user name). The money for top up was reimbursed to him. However, last month he has changed on his own to postpaid using his residence address and got NOC from his current employer. The problem is that our clients have access still and he can divert our biz to his co. Also there is scope to fraud transactions on our name.
He may also refuse to acknowledge our reg.post letter sent to residence. We are thinking of approaching him at his new office or contact the police. Pls advise.

without waiting, with the approval from Top Magnt, do police complain and yes, under the Factory Act, without prior intimation, if employee remain absent for more then 8 days (may be 10 as per standing order,leave policy), his absent reveals his own resignation. Go for Police complain.

Yes, try to contact missing employees - if need be by a couriered letter requesting a meeting personally at new office or home. You can file an employment relationship problem against a missing employee - by abandoning they effectively resign without notice. I think you hold the right to seek a penalty or damages.

This is very simple task, Jus t you hold the sim card, his full and final settlement. just ask personally about his absence. not you make some your collegues to talk. after get the details from the employee jus tyou give a warning notice, after his reply or not youtake the further action as by the management sugrestion. don't gets tensed. if any thing else you may call +919846704221.
