In our company we have frame a chargesheet to a employee for his unauthersised absent from duty in the month of July 08 and when we issue he is refused to accept the same and plea that why it is issue so late.My question is whether it is justified or not.And if he is deny to accept the letter then what is the next procedure.Kindly suggest.

He can not question the date of issuance of charge sheet. It is up to the employer when should he issue charge sheet.
If he refuses to accept the charge sheet you may send it to his residential address by Registered Post and collect the acknowledgement. If he doesnot turn up within the time specified you can send another letter posting a domestic enquiry and conduct the disciplinary action against him.

If the employee is attending now,the charge sheet should be offered again in presence of two witnesses & if refused, the refusal to be recorded in presence of the witnesses & their sign. to be obtaied on original chargesheed. Subsquently also issue a fresh chargesheet for 'Refusal of Mgnt. communication' which is misconduct as per Standing orders & conduct domestic enquiry by giving proper notice of enquiry & following principles of natural justice & examine the witnesses to esablish 'refusal charges'.

If you are going to impose minor penalties, you need not issue a Charge Sheet,you can just issue a memo seek his explanation & close by mposing a minor penalty if you find his explanation not satisfactory.
