Hi Seniors,

Please help me out in the below issue. I'm in a very worse situation

I have been an employee of a certain company. I joined that company as a fresher. i worked for that company for more than 2 years. In my company, the employee need to serve notice period of 45 days. But i was short of my notice period by 30 days. I informed my employer about this that i would be serving notice period of 14 days. But they refused, and i even asked for buying out my notice period. But they didnt agree to it. As i was having a job at my hand and they were having a urgent requirement i didnt serve my whole notice period.

Now after 1 month, my current employer is asking for a relieving letter. When i went to my previous company they say they wont give any relieving letter to me and on the other hand they wont give any other alternative to me. They say in their record i'm an absconder and i've been terminated. It needs to be mentioned that they conducted my exit interview. In my company they send an absconding letter but till yet i'vent recieved any letter from the company. They say they've sent the absconding letter to me.

Can anyone help me out in this case. Can anybody advise whether i can get my relieving letter from my previous employer. Or can i take legal actions against the company. Please answer to this question. My career is on stake...

Frankly speaking If you have worked for tow years with one organization then you must show respect acknowledging them for giving you an opportunity and requesting humbley without blame game for departing like good friends with happy memories.
You could have served notice period with request for early relieving, if not matter could have been persued further or asked your prospective employer to wait or extend joining time.
Now you left bad impression and into the bad books of your past company is not good for you. Now,you have to persue your case with the top management such as CEO or MD apologizing for wrong behaviour or not adhering to notice period or whatever reason with very straight forward approach for the mercy of your previous employer for relieving letter.
It is not advisable to confront with them, or argue because when we at fault we should not argue and accept our mistake. We cannot fight legal battel for pitty issues there some issues needs amicable settlement this one among such cases.

I truely agree with Sawant, You could have served the notice period by posponing joining formalities with the new company.Fine past is past. But, a sincere apology will surely help you talk to the top management not your manager as the colleagues in between spoil the whole case.

Hi kotian,
I went through your mail and I am sory to note that you have been branded as an absocnder by the previsous employer and the present employer wans releiving letter form the previous letter. The only option in front of you is to submit the resignation letter tendered to your previous organization and i hope you might have obtained the acceptance on your resignation letter and some how convince your present employer, since the time frame for joining with the present organization was very less and subsequently you could not serve your notice period with the previosu organization as all lead to this kind of discrepancies. Any how you need play your cards very diplomatically.
