Hi, Please help me out in the below issue. I'm in a very worse situation I have been an employee of a certain company. I joined that company as a fresher. i worked for that company for more than 2 years. In my company, the employee need to serve notice period of 45 days. But i was short of my notice period by 30 days. I informed my employer about this that i would be serving notice period of 14 days. But they refused, and i even asked for buying out my notice period. But they didnt agree to it. As i was having a job at my hand and they were having a urgent requirement i didnt serve my whole notice period. Now after 1 month, my current employer is asking for a relieving letter. When i went to my previous company they say they wont give any relieving letter to me and on the other hand they wont give any other alternative to me. They say in their record i'm an absconder and i've been terminated. It needs to be mentioned that they conducted my exit interview. In my company they send an absconding letter but till yet i'vent recieved any letter from the company. They say they've sent the absconding letter to me. Can anyone help me out in this case. Can anybody advise whether i can get my relieving letter from my previous employer. Or can i take legal actions against the company. Please answer to this question. My career is on stake...

You request your previous company about relieving letter or ask for acceptance of your resignation letter. and also talk to your current employers hr person about this situation but dnt tell them that they are saying that you are terminated. just tell hr that your previous company is not giving you relieing letter. and also if you have some good contacts in your previous company you can give their refrences to current so that they can confirm. But rememeber that whenever you left the job dont spoil relations with any body. because we need any body any time. so better to maintain good relation. whether you get a good job you should not spoil that and dnt never think that you will not need them any time. You ask your current hr may be they will understand your situation and also submit your all salary slips. Inform me whatever happens. Best Regards. Thanks Pooja very much... But what has happend is that my manager has given good reveiw on my side but the only black patch to this is that i've absconded... but i'll try to ask my HR...... But am i entitled to recieve the relieving letter even in this worst case scenario??? will let you know about my discussion with the HR team..... thanks again....

yes they can deduct your pay but they should give you relieving letter or acceptance letter. any ways if your hr is realy hr than they will help you or guide you about the same dnt worry. Best regards. Pooja

Hi, Would like to intervene at this if you don mine. I have a few clarifications in this regard, Why your present employer is insisting on relieving letter after so long - after 1 month after joining them??? Was it not informed to your present employer that you will be short serving the notice period with your previous employer? You should have either convinced your previous employer or your present employer in terms of notice period and date of joining. Anyways let gone be bygone. Now all that you can do is to meet the HR of your present employer and explain what had actually happened with your previous employer. Also explain the difficulty in getting a relieving letter from your previous employer. If your present employer has had a system of proper background verification and a proper joining formalities, you would not have been put in such situation. Very all the best to you - DISCUSS AND EXPLAIN THINGS TO YOUR PRESENT EMPLOYER INSTEAD OF APPROACHING YOUR PREVIOUS EMPLOYER AS IT MAY WORSEN YOUR RELATIONSHIP WITH THEM.
