Dear Seniors, I am working in an event management company. Recently our company got a project on a promotion campaign. The project is for one year. Now our management has suggested to recruit employees on a contract basis. Please suggest me how should I go further in recruiting them and what should I need to follow. Awaiting for early response. Thanks, Rajesh

Dear Rajesh:-P, The contract manpower can be recruited in two ways: 1) On company rolls but by signing a contract for specified period at the time of joining. 2) Through recruitment consultants who outsource manpower for specific time period. I find second option better as the consultants themselves manage their PF and ESI norms, thus no record keeping is required by you. Hope this information will help you. Regards, Kopal

Dear Rajesh, While recuriting employees for short term certain legal paramaters have to be considered and drafted accordingly so that when the term or the project gets over the employee do not claim regularisation. If you need help you can right to we will provide you with a draft.

Hi Swatik, As Mr. Kopal advised you that for the second option, which is that, hire the manpower from outsource manpower supplier. But,don't be relax, If your going to planing for the choose the above option & if the manpower may be more that 21, So you have to register under The Contract Labour Act. & take a registration certificate for the employing the manpower on contract basis. As well as you have to maintain some documents as principle employer. like salary, attendance, loan, advance, deductions, & other register. You have to be sure about their salary or wages... like Are they paying the salary or wages as Minimum Wages act. or not. & other things. you have a need to submit the Annual return of same on Annual basis. & You have to follow the Rule & Regulation as per mentioned in The Contract Labour (R & A) Act. 1971 For more information about it, Please refer the above mentioned act. Please note:- I don't know to scare you, I am just telling the Legal process exact. Which you will face in future.. Regards,
