I want to know the legal issues involved if I leave the company without getting relieving letter. My scenario is I have joined this company two months back and I found that the work they promised is nowhere near to work they are giving me. So i searched for a new job and found it.
Now my present company is not ready to relieve me before 1 month even though I am ready to give one month salary. So if i just stop going to office and join my new company will there be any legal issues.

it depedns on your existing company policy and your new company’s policy. Find out whether your new company is ready to accept with relieving order.

My New company is ready to take me without releiving letter.. If i provide them the offer letter it is fine with them and my present company have "You need to give one months notice period when you leand and company can terminate my service either by giving one month notice or one month salary" in offer letter.
So will my present company will be able to take any legal action against me I just stop going..
Any help or poiter will be of great help

then do onething. Apply for long leave due to some medical reasons...Let us wait and see... and when you are ready to give your one month salary they are supposed to give you your relieving order. If not you can send a lawyer notice asking for the relieving order..

Hi Devendra,
If your new organization is not insisting for a releveing letter do not insist for it from last organization. I think you are also not going to present this in your cv in future.
If you insist for ea releiving letter, u have to pay one monthg salary if mention in the offer letter.

If I just leave the company without getting any relieving letter and join another company can they take some legal action against me. Please note that I have given them a resignation letter and also one month salary.. but they are not ready to give the relieving letter before one month. Also I have taken a copy of the resignation letter and got it signed from my manager as a proof that I have actually given them a resignation.

I would suggest you to get the relieving letter coz your current employer can sue you for working in 2 org. at a time, why take chances.
I recommend you to be proactive and take action(legal or moral) against your current employer (This is possible because you are prepared to forego your month's salary- Which is required as per rules) & get the relieving letter somehow.

Submit your resignation by stating the clause of your appt.order in which the provision of 1months notice or pay in lieu thereof is available.
State that you are ready to forego your salary and then join the other company. I think there would be no issues for the current employer.

You can submit the resignation along with the photocopy of the appointment letter. After that you can approach the company through legally with a lawyer notice, but whatever document you submit to the company take a copy of everything. This will help u..

if joined 2 months back and resigned. their is no need of any releiving letter untill you filed a bond for the employment.
Just join ur new firm and forget all.
